Senior Legal Counsel


Shanghai - China

About the role

Main Duties/Responsibilities:

  1. Developing the position of the subject expert in one or two practising areas such as employment, competition, e-commerce within Greater China as a strategic adviser, building engagement with the relevant leadership team and business partners.

  2. Working with Group/Regional internal stakeholders on advertisement claims review to analysis the risk of legal challenge in market including assessing testing results to substantiate claims;

  3. Working with other Group/Regional Legal teams on investigation and implementation of authority and competitor challenges.

  4. Independently supporting the day to day operations of the business  including:

  • Providing timely practical legal advice and support regarding  advertising law, E-commerce law, unfair competition law, tort law, consumer protection law and product quality law;

  • Identifying risks and working with the business to develop risk mitigation solutions;

  • Drafting and presenting legal opinions or suggestions on certain project related to marketing, PR, technical policies and other legal issues;

  1. Providing expert, ethical and pragmatic advice on a wide range of employee relations matters, including disciplinary issues, benefits and policy compliance.

  2. Managing all formal and informal employment related claims and litigation.

  3. Supporting HR policy development and roll out and creating and maintaining relevant precedents.

  4. Drafting and negotiating employment contracts and settlement agreements.

  5. Managing external counsel where appropriate, ensuring compliance with Dyson’s cost management processes.

  6. Providing legal training with General Counsel, Greater China to the Sales, Marketing, Communication, PR and functional teams.

  7. Updating new laws and regulations to ensure organizational awareness of government legislation and/or regulatory issues that affect the organization and respond to same;

Rendering comprehensive legal support as directed by General Counsel, Greater China.

About you

Skills / Experience Required:

  1. 8+ years professional experience (PQE) of which at least 3 years should have been spent in-house in an MNC of FMCG, e-commerce or household electrical appliance business;

  2. Has a strong work ethic, positive attitude and the highest integrity;

  3. Has a solid experience and understanding in advertising law, E-commerce law, unfair completion Law, tort law, consumer protection law, product quality law and employment law. The experience in anti-counterfeiting is a plus;

  4. Has a solid commercial law understanding and an ability to apply that knowledge in a practical way;

  5. Has a good awareness of the role of Legal in business decisions with problem solving thinking ;

  6. Self-starter who is good at identifying issues and proactively remedying them;

  7. Has the ability to interact with all levels in the business to establish the legal interface to effective execution;

  8. Experience of managing matters with a cross border and foreign jurisdiction element, and managing external legal counsel;

  9. An ability to work successfully with a minimum level of supervision in a fast-paced, constantly changing environment;

  10. Experience in developing policies and procedures for ensuring corporate compliance required;

  11. High degree of organisational and time management skills, with a proven ability to manage multiple, complex projects when necessary;

  12. Must be able to travel domestically and internationally as required

  13. Be effectively bilingual in English and Mandarin.

  14. Has the confidence and technical ability to be able to deal with issues outside of their experience and learn quickly on the job;

Has the confidence and gravitas to meet business demands of local Business Units or departments for which he/she is assigned to be responsible.
